Privacy Policy

I. Definition

1. Definition of Terms

1.1. Provider
A registered company that provides services for the Client.

1.2. Client
An entity or person that uses services according to thunderproxy.com Terms of Use, authorized with the service Provider.

1.3. Confidential Information
All confidential information (anyhow recorded or maintained) provided by a Client or by its staff, representatives, or affiliated entities (Associated Persons) to the Provider (Receiver) and the Provider’s Representatives in connection with this Agreement, that is either classified as such or otherwise should be treated as confidential because of its origin and the way it was provided.

2. Confidential Information

2.1. Confidential Information is not information that:

  • Is in or passes into the public domain (except if it is disclosed by the Receiver or its Representatives in violation of the confidentiality provisions of this Agreement);
  • The Receiver had access to on non-confidential grounds before receiving it from the disclosing party;
  • Was, is, or becomes disclosed to the Receiver on non-confidential grounds from someone who, to the Receiver’s knowledge, is not obligated by a confidentiality agreement with the Client or otherwise restricted from sharing the information;
  • The Receiver had known before the information was shared by the Client; or
  • Both parties agree in writing is not confidential or may be published.

III. Definition

3. Use of Confidential Information

3.1. Both parties must keep each other’s Confidential Information confidential and must not:

  • Use any Confidential Information except in accordance with the rights and responsibilities described in this Agreement (Permitted Purpose); or
  • Disclose any Confidential Information, in whole or in part, to any third party without the Client’s consent.

3.2. A party may disclose Confidential Information to its Associated Persons who need such information for the Permitted Purpose, provided that:

  • Those Associated Persons are informed of the confidential nature of the information prior to disclosure; and
  • The disclosing party remains responsible for the Associated Persons’ compliance with the confidentiality obligations set out in this Agreement.

3.3. A party may disclose Confidential Information if required by law, by any administrative or regulatory authority, or by a court or other authority of competent jurisdiction, provided that, to the extent legally permitted, it informs the other party of such disclosure as soon as possible.

3.4. Each party retains all rights to its own Confidential Information. No rights or obligations relating to the other party’s Confidential Information, other than those expressly set out in this Agreement, are granted or implied.

3.5. The provisions of this section shall survive the expiration or termination of this Agreement.


IV. Definition

4. Cookie Policy

4.1. The Provider has the right to collect data regarding the Client’s cookie usage in accordance with applicable privacy and data protection laws and regulations.

4.2. The Provider uses cookies to improve and secure the services and to facilitate their delivery. Collected information may also be used for research, statistical, and advertising purposes.

4.3. Collected information is stored by the Provider and is not disclosed to third parties.
